1. Scope and acceptance

These Terms of Use govern access to and use of www.tapio.my and any pages, materials, publications, forms or other content made available through the website (the Website). The Website is operated by TAPiO Management Advisory Sdn. Bhd. (TAPiO, we, us or our).

By accessing or using the Website, you agree to these Terms. If you do not agree, you should not use the Website. Additional terms may apply to particular services, events, portals, downloads or engagements. Where an engagement letter, proposal, contract or other written agreement with TAPiO conflicts with these Terms, that agreement governs the relevant engagement.

2. Information, not professional advice

The Website provides general information about TAPiO, Malaysia, ASEAN, international business, market entry, investment, government relations and related subjects. Website content is prepared for general informational purposes and may not reflect the facts, law, regulation, market conditions or circumstances applicable to a particular organisation or transaction.

Unless expressly stated in a written engagement, Website content does not constitute legal, tax, accounting, investment, financial, regulatory, immigration, employment or other regulated professional advice. You should obtain appropriate professional advice before acting on information that may materially affect your business, investment, rights or obligations.

Market information, statistics, quotations, third-party data and external materials may change without notice. TAPiO may update, correct, remove or replace Website content at any time.

3. No client relationship or commitment

Visiting the Website, submitting a contact form, sending an email, downloading material or communicating with TAPiO does not by itself create a client, fiduciary, agency, partnership, joint venture or other advisory relationship. TAPiO accepts an engagement only through an authorised written agreement.

Nothing on the Website constitutes an offer, guarantee, promise of government approval, investment outcome, commercial result, introduction, financing, licence, incentive, permit or other decision by TAPiO or any third party.

4. Permitted use

You may access, read, download and make reasonable internal business use of Website content for lawful purposes, including evaluating TAPiO and considering matters relevant to your organisation.

You must not:

  • use the Website for unlawful, fraudulent, misleading, defamatory or harmful purposes;
  • interfere with the Website, its hosting, security, access controls or other users;
  • attempt to gain unauthorised access to systems, accounts, data or restricted areas;
  • introduce malware, malicious code, automated attacks or unreasonable traffic;
  • misrepresent your identity, authority, relationship with TAPiO or the origin of Website content;
  • use TAPiO names, logos, marks or content in a way that suggests endorsement or affiliation without written permission; or
  • use Website content in breach of applicable law or third-party rights.

5. Intellectual property

Unless otherwise stated, the Website and its original text, designs, branding, graphics, photographs, videos, reports, presentations, databases and other materials are owned by or licensed to TAPiO and are protected by applicable intellectual-property laws.

Reasonable quotations and links may be used where permitted by law and where TAPiO is clearly identified as the source. No other licence is granted. In particular, you may not reproduce, republish, sell, sublicense, modify, distribute or commercially exploit substantial Website content without prior written permission.

Third-party names, logos, photographs, documents and other materials remain the property of their respective owners and may be subject to separate terms.

6. Automated access, scraping and data extraction

Automated indexing by bona fide search engines is permitted subject to applicable robots directives. Other automated scraping, harvesting, bulk downloading, systematic extraction, circumvention of technical controls or creation of a substitute database from Website content is prohibited without TAPiO’s prior written permission.

Use of substantial Website content to train, fine-tune or build a commercial artificial-intelligence model or competing information product requires prior written permission unless such use is expressly permitted by applicable law.

7. Communications and submissions

Information you submit through the Website should be accurate and should not contain material that you are not authorised to provide. Do not send highly sensitive, privileged or security-critical information through a general Website form unless TAPiO has asked you to do so through an appropriate channel.

When you provide documents, data or other materials for an enquiry, you confirm that you have the authority to provide them for the stated purpose. Personal data is handled in accordance with our Privacy & Data Protection Notice.

8. Third-party services, embedded content and links

The Website may link to or embed content from third parties, including government agencies, professional organisations, media platforms, mapping, video, social-media or other service providers. Third-party services are controlled by their respective operators. TAPiO is not responsible for their availability, security, accuracy, terms or privacy practices.

A link, reference, logo, event participation, photograph or third-party mention does not by itself imply endorsement, partnership, agency, accreditation or approval unless TAPiO expressly states otherwise.

9. Website availability and security

We take reasonable measures to maintain the Website and protect it from misuse, but we do not guarantee uninterrupted, error-free or completely secure operation. Access may be suspended for maintenance, security, legal or operational reasons.

You are responsible for using appropriate device, network and cybersecurity protections when accessing the Website or downloading files.

10. Disclaimers

To the fullest extent permitted by applicable law, the Website and its content are provided on an “as is” and “as available” basis. TAPiO does not make a warranty that Website content is complete, current, suitable for a particular purpose or free from error.

Nothing in these Terms excludes any warranty, right or remedy that cannot lawfully be excluded.

11. Limitation of liability

To the fullest extent permitted by law, TAPiO and its directors, officers, employees and authorised representatives will not be liable for indirect, consequential, special or incidental loss arising solely from use of, inability to use, or reliance on the Website, including loss of profit, revenue, opportunity, goodwill or data.

TAPiO’s liability is not excluded or limited where doing so would be unlawful, including liability that cannot be excluded under applicable law. These Website limitations do not replace or alter liability provisions in a separately executed client engagement.

12. Privacy and cookies

Our processing of personal data is described in the Privacy & Data Protection Notice. Our use of cookies and similar technologies is described in the Cookie Notice. Where required, non-essential technologies should be controlled through the Website’s consent mechanism.

13. International access

The Website is operated from Malaysia and may be accessed internationally. TAPiO does not represent that every item of Website content is appropriate, available or legally permissible in every jurisdiction. Users outside Malaysia are responsible for complying with laws applicable to their access and use.

14. Governing law and jurisdiction

These Terms and any non-contractual dispute arising from use of the Website are governed by the laws of Malaysia. Subject to any mandatory rights that apply under another law, the courts of Malaysia have exclusive jurisdiction over disputes relating to these Terms.

15. Changes to these Terms

We may amend these Terms to reflect legal, operational, security or Website changes. The effective date shown at the top of this page indicates the current version. Material changes may be highlighted where appropriate.

16. General provisions

If a provision of these Terms is held invalid or unenforceable, the remaining provisions continue in effect. A failure to enforce a provision is not a waiver of that provision. These Terms constitute the agreement governing Website use only and do not supersede a separately executed TAPiO engagement.
